Fubara Impeachment: Court Lacks Power to Intervene - Rivers Assembly

The Rivers Assembly says the court lacks the power to intervene in the Fubara impeachment process.

Newsone Nigeria reports that the Rivers State House of Assembly has condemned an order by the Rivers State High Court, stopping the ongoing impeachment of Governor Siminalayi Fubara and his Deputy.

The court issued an interim injunction on Friday restraining the Speaker of the Rivers State House of Assembly, Martin Amaewhule, and the Clerk of the House, from sending any correspondence to the Chief Judge of the state.

The Rivers State High Court also stopped the state’s Chief Judge, Justice Simeon Amadi from making any step towards the impeachment process.

However, the spokesman of the Rivers Assembly, Enemi George, said the court lacks the power to intervene in the matter.

Enemi, who was contacted by DAILY POST, said the assembly is not aware of any court order, stressing that section 188(10) of the Nigerian constitution does not allow the court to intervene in the impeachment of a state governor.

The Rivers Assembly spokesman said, “The House is not aware of any court order. However, if you read section 188(10), the court has no power to intervene in the impeachment process”.
