An appeal filed by the Peoples Democratic Party (PDP) and its presidential candidate, Atiku Abubakar, has been dismissed by the Supreme Court.

YaahooJournalist reports that a five-man panel of the apex court led by Justice Dattijo Muhammad said the appeal was statute-barred.

PDP and its Presidential candidate filed the appeal to challenge a ruling of the Presidential Election Petition Tribunal which held that they failed to file a response to an application by the All Progressives Congress.

On the other hand, APC’s application had prayed for among others the dismissal of the appellants’ petition at the tribunal.

The ruling by the Supreme court is coming barely 24 hours to the closing of arguments by parties to the petition scheduled to come up on Wednesday.

PDP and Abubakar, a former Vice President of Nigeria are by their petition before the tribunal challenging the victory of President Muhammadu Buhari at the February 23, 2019 election.
